The "You Gotta See This" Video Contest

OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT ENHANCE YOUR OPPORTUNITY TO WIN.
Open to residents of the 50 United States or the District of Columbia, ages 21 and older.


HOW TO ENTER

  1. To enter the "You Gotta See This" Video Contest (the "Contest"), entrants must first become registered users of www.gottaseethisnow.com by completing its registration process. Next, visit the contest page at http://www.gottaseethisnow.com, and follow the instructions. Entrants must submit a video showing how life is better with great vision. The video must fall into one of the following three categories:
    1. "My contacts are getting in the way of my good time"
    2. "My favorite sport or activity would be so much cooler with better vision"
    3. "You should see life after the iLASIK  Procedure"
    Additional consideration will be given to videos that include, either in text or voiceover, the phrase "You Gotta See Life With The iLASIK  Procedure." Any music, sounds, props or other creative elements used in the video must be the entrant's own work; entrant must own all copyrights and hold all releases; and the video must not infringe upon or violate any rights. Video submissions must be ninety (90) seconds or less in length. Contest submissions will be accepted between 12:00:01 a.m. Pacific Time ("PT") on September 10, 2009 and 11:59:59 p.m. PT on December 10, 2009 ("Entry Period"). Limit one entry per person and per gottaseethisnow.com account.
  2. By entering the contest, entrants agree to abide by these rules, and represent and warrant that the entries are their own and original creations, and do not violate or infringe on the rights, including, without limitation, copyrights, trademark rights or rights of publicity/privacy, of any third party.
  3. Entries are void if they are incomplete or damaged. No responsibility is assumed for late, lost, incomplete or misdirected entries. Entries must be suitable for viewing (i.e., not obscene, offensive or indecent). Abbott Medical Optics Inc. ("Sponsor"), in its sole discretion, reserves the right to disqualify any entry or reject any comment containing racial or ethnic slurs, explicit language or sexual content or otherwise inappropriate, offensive, defamatory or illegal material.
  4. Sponsor and its parent, subsidiary or affiliated companies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to play or participate, or by any human error which may occur in the processing of the entries. If for any reason the Contest is not capable of being conducted as described in these rules, Sponsor shall have the right to cancel, terminate, modify or suspend the Contest. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized holder of the registered account.

JUDGING

  1. From September 10, 2009, 12:00:01 a.m. PT through December 10, 2009, 11:59:59 p.m. PT registered users of gottaseethisnow.com can vote on their favorite "You Gotta See This" videos. Users may vote for more than one video per day, but users may not vote more than once per day for the same video.
  2. The winners will be chosen by a select panel of judges based on the following criteria:
    • Overall creativity, originality and humor
    • Association with the topic of better vision
    • Popularity: judges will consider the total number of views that the video receives while posted online, and the average rating of the video
  3. The decisions of the Sponsor with respect to the selection of the winners, and in regard to all matters relating to this Contest, shall be final.
  4. Winners will be notified by e-mail or telephone following the close of the Contest Voting Period. If a winner is unable to be contacted or verified after five (5) business days, then an alternate winner may be selected at the Sponsor's discretion.

PRIZES

  1. One Grand Prize Winner will win $5,000, the market value for the iLASIK  Procedure. The Grand Prize winner will be selected from all submitted videos.
  2. Three First Prize Winners will win an HDTV package — a $2,500 value. One First Prize Winner will be selected per submission category.
  3. Three Second Prize Winners will win the Flip UltraHD™ camcorder — a $199.99 value. One Second Prize Winner will be selected per submission category.
  4. In the event that there is an insufficient number of qualified entries or if the Sponsor determines in its absolute discretion that no or too few entries meet the quality standards established to award the prizes, Sponsor reserves the right not to award the prizes.

ELIGIBILITY

  1. Open to residents of the 50 United States or the District of Columbia, ages 21 and older. Void where prohibited by law. All state and local restrictions apply.
  2. Employees, and their immediate family members living in the same household, of Sponsor, its parent, subsidiaries, or affiliated companies or the agencies of any of these, are not eligible for this Contest.

GENERAL

  1. No cash substitution, transfer or assignment of prizes allowed. In the event of the unavailability of a prize or prizes, Sponsor may substitute a prize or prizes of equal or greater value.
  2. All expenses, including taxes (if any), on receipt and use of prizes are the sole responsibility of the winners.
  3. Winners may be required to execute an Affidavit of Eligibility and Release. The affidavit must be returned within fourteen (14) days of notification or another winner will be selected. Should the ARV equal or exceed $600.00, winners shall be required to provide a Social Security Number or an Individual Taxpayer Identification Number to Sponsor for issuance of a 1099 Form.
  4. By entering the Contest, entrants grant to Sponsor the right to edit, publish, copy, display and otherwise use their entries in connection with this Contest, and to further use their names, likenesses, and biographical information in advertising and promotional materials, without further compensation or permission, except where prohibited by law.
  5. By participating in the Contest and/or accepting a prize, contestants release Sponsor, its parent, subsidiary and affiliated companies or the agencies of any of them from any liability, injury, damages, cost or expense, including reasonable attorney's fees, arising out of or connected to participation in this Contest or the acceptance, possession, use or misuse of any prizes.
  6. Any dispute arising from this Contest will be determined according to the laws of the State of California, without reference to its conflict of law principles, and the entrants consent to the personal jurisdiction of the state and federal courts located in Orange County, California, and agree that such courts have exclusive jurisdiction over all such disputes.

Laser assisted in-situ keratomileusis (LASIK) can only be performed by a trained physician and is specified for reduction or elimination of myopia, hyperopia, and astigmatism as indicated within the product labeling. Laser refractive surgery is contraindicated for patients: a) with collagen vascular, autoimmune, or immunodeficiency diseases; b) who are pregnant or nursing women; c) with signs of keratoconus or abnormal corneal topography; d) who are taking one or both of the following medications: Isotretinoin (Accutane) and Amiodarone hydrochloride (Cordarone).
